The conditions of services offered by MySecretAgent.com:
We offer limited service for a flat fee. Our flat fee service will not provide the same services as a “traditional” brokerage. We do not represent any buyers or sellers unless agreed upon in writing. We do not provide legal advice, handle earnest money or earn a listing commission on our flat fee listings. We shall not have liability or responsibility regarding property information contained within our web site, MLS or other sources including information provided by sellers regarding properties listed anywhere.
You are paying a one time flat fee of $95, $295 or $495 rather than the more common percentage fee typically charged by full service brokerages. We provide these services only as a Non Agent/Facilitator. As a seller you represent your property as your own agent. Our service consist of entering the information you submit to the Multiple Listing Service directory and other online real estate related sites.
The Basic $95 package includes listing your home on the NWMLS for 90 days with one photo, CMA via email. No other services are included in the basic package. No broker support is provided in this package. All support will be charged at $75 an hour, minimum 1 hour.
The Extended $295 package includes listing your home on the NWMLS for 6 month with eight photos, CMA via email, and a yard sign with your phone number. This package povides a one hour phone or e-mail broker support, after the one hour is used you will be billed at a $75 an hour rate.
The Full $495 package includes listing your home on the NWMLS for one year with fifteen photos. Other services include yard sign with your phone number and a flyer box, professionally designed pdf flyer emailed, 50 color glossy flyers mailed, CMA via email, and listing your home on REALTOR.com® plus post it on Zillow, Trulia, Yahoo Real Estate, Craigslist, Facebook, Twitter, MLSonline, Google Base, Oodle, Vast, HotPads, Backpage, Trulia, ByOwnerMLS, Enormo, DotHomes, FrontDoor and many others. This package povides a one hour phone or e-mail broker support, after the one hour is used you will be billed at a $75 an hour rate.
Syndication to other websites (Web syndication is a form of distribution in which website material is made available to multiple other sites.)
Every website is different. They display information according to their own criteria. Since we don't have control over third party systems, we cannot confirm that every listing will be indexed properly. Sometimes it can be difficult to isolate your listing, but the best way is to search for unique identifiers (part of the listing subtitle, name, address, etc.), and don't forget to filter on attributes such as number of bedrooms or bathrooms on the respective third party sites.
Syndication is not immediate. We send new listing info the following morning and it usually takes 12-24 hours to appear on the other sites. If you have incomplete or inaccurate information, your listing may not be processed by our syndication partners. If your listing is also syndicated from another source, that may also interfere with syndication. MySecretAgent.com cannot control how and when your listing is displayed on other sites. As websites are constantly evolving, syndications to other sites may change at any time.
Craigslist prohibits "posting agents" to post on behalf of others. MySecretAgent will email you the craigslist HTML code for your listing. You will need to manually create a craigslist post and copy and paste the provided HTML code into the description box. You will need to enter some basic information first and then manually copy and paste the provided HTML code into the posting description box to get your listing onto craigslist. Craigslist will send you an email to activate and manage your post, as usual. Hold onto this so that you can later edit/delete your post. Listing on craigslist will be valid for one week only.
When you find a buyer who is not represented by an agent, you may enlist our services to prepare the Purchase and Sale Agreement and help facilitate the closing. Our charge for this service is 2 hours minimum at $75 per hour, not to exceed the 3% buyer's agent commission of the selling price. We may represent any buyers or sellers and act as a "dual agent" with the written consent of both parties to the transaction which consent will include a statement of the terms of the above hourly compensation.
Buyers are responsible to independently verify the accuracy and completeness of all information contained within each property advertised.
After you submitted the online information, your order is placed. Send us your signed Listing Agreement and Addendum. These forms will be emailed to you once we receive your order, please read, sign and fax or mail back these forms to our office. Once your signed documents, your online form with your photographs, and payment are submitted to us, your property will be listed in the MLS the same day if received by 1:00 P.M. If we receive your documents and photographs after 1:00 P.M. or on the weekend, your property will be posted the next business day. All other websites, including REALTOR.com® will post your listing within 4-5 business days. Changes to an MLS listing are handled in the same fashion.
When you are entering your information you are not directly updating the MLS.
The yard sign with a flyer box and your contact information will be posted on your property within 2-3 business days. A professionally designed listing flyer will be emailed to you within 2-3 business days, you can print it or email it as needed. This service is included in the Full $495 Package. The Extended $295 Package included a yard sign, and it is optional with the Basic $95 Package. You may choose to purchase additional services at any time, including the lock box, you can log in to My Account to order, and it will be shipped within one business day. Printed materials such us flyers, brochures and postcards will be emailed for your approval within 1-2 business days and they will be printed and shipped 3 business days after your approval. Reorders are handled the same way.
You may sell your home on your own and pay no other fees, the customary commission is 3% but all commissions are negotiable, we recommend that you offer a 3% commission to the selling agent. This ensures that real estate professionals from other companies will show your home. The 3% is to be paid only if you accept an offer from a buyer with a real estate agent involved.
When you accept an offer on your property you must notify us within 24 hours by email or fax. The failure to do so will result in a fine by the MLS, which will be charged directly to you. We reserves the right to cancel your listing if we cannot contact you for longer than 2 weeks by phone or email.
In order to minimize the risk of misuse of the key box we recommend against the use of key boxes on door handles that can be unscrewed from the outside or on other parts of the home from which the key box can be easily removed. As agents will have access to your property you should remove all valuables or put them in a secure place. MySecterAgent.com is not responsible for any valuables lost or stolen during an open house or showings by licenced agents.
The key box and the open house signs must be returned within 7 days after your home is sold or cancelled, if not received within a week, or if they are lost or damaged, there will be no refund on your deposit.
If you discover an error please notify us promptly so the error can be corrected. We make all attempts to accurately enter the information you provide into the multiple listing service. However, we do not guarantee error-free service. We are not responsible for any loss or damage suffered by the error. We at MySecretAgent.com work on maintaining our web site and services, but we are not responsible for defects that may exist within our web site or any resulting loss of profits or other damages. We shall not have any liability greater than the amount we have received from you for services.
Payment and refund policy:
Payment will be processed before we enter your property in the MLS or ship your listing tools. We accept Visa, Master Card and American Express.
You may cancel your listing at any time. If you cancel your listing before our documentation is submitted to the MLS or cancel the product purchases before they are shipped, you will be charged a transaction fee of $25 which will be deducted from the original price of $95, $295 or $495 and you will receive the remaining amount as a refund.
After your listing is entered in the MLS or the ordered products are shipped, there are no refunds. Once your listing is submitted to the MLS, the service you paid for is provided. If you wish to take your property off the market, you will not be charged any cancellation fees.
If you renew your $495 listing before the expiration date you may re-list for only $295. If you renew your listing after the expiration date the listing fee will be at full price of $495. There is no discount to renew the Basic $95 or the Extended $295 packages.
Selling and buying real estate is a very serious endeavor as such, we encourage all parties to consult an attorney. Furthermore, we encourage and support FAIR HOUSING LAW in which there are no barriers to obtaining housing based on race, color, religion, sex, handicap, marital status and national origin.
You agree to hold MySecretAgent.com harmless from any and all claims or damages arising from you providing incomplete and/or inaccurate information to us. MySecretAgent.com is not responsible for the content of any off-site pages or any other sites linked to our site. Furthermore MySecretAgent.com is not responsible for any damages that may arise from an open house or from licensed agents showing the home, including loss or injury to person or property.
The information provided in our site are meant for customers and potential customers interested in buying and selling real estate and agents who represent buyers interested in buying properties.
